Woman is Ordered to Pay Man Who Raped Her When She Was 16 Child Support and Give Him Full Custody of Their Daughter

A Louisiana judge gave an accused rapist custody of the child conceived from the 2005 attack and eventually ordered his underage victim to pay child support, a report said.
Crysta Abelseth told WBRZ that she was raped at 16 years old when a man nearly twice her age promised to give her a ride home from a local restaurant after a night out with friends.
“Instead of bringing me home, he brought me to his house,” Abelseth said about John Barnes, who was 30 at the time. “Once inside, he raped me on his living room couch.”
The teen became pregnant and had a daughter, who is now a teenager herself, the station said.
“Everyone assumed it [the pregnancy] was from a boyfriend, and I let them believe that,” Abelseth told the outlet.
“When my daughter was 5 years old, he found out about her, and once he found out about her, he pursued custody and wanted to take her away from me,” Abelseth said, explaining that a DNA test proved with near certainty that he was the father.
“They granted him 50/50 custody despite the fact that [the child] was caused by rape.”
Abelseth filed rape charges against Barnes in 2015 after she found out it was within Louisiana’s statute of limitations, the station reported.
…The now-32-year-old said she has struggled to gain any traction with the justice system and reportedly lost custody of her daughter over allegations she gave her a cellphone.
Court records in connection with the case were inexplicably sealed, according to the article.
“He’s well connected,” Abelseth told the station of Barnes, who owns Gumbeaux Digital Branding, a web company in Ponchatoula that works with local police.

A Louisiana mother who claims she was raped at 16 by a 30-year-old-man has been ordered to give up custody of their daughter sixteen years later – and pay him child support in a cruel legal twist.
Crysta Abelseth, now 32, claims that John Barnes, now 46, raped her in 2005 after she accepted a ride home from him from a bar where she had been drinking with friends. She was 16 at the time and had been in the bar with friends.
Six years later, she says he found out about the baby but did nothing about it until 2015, when he suddenly requested 50/50 custody.
She then filed a police report, alleging the rape ten years prior, but he was never charged – even though Louisiana has clear statutory rape laws that apply to anyone under the age of 17.
Now, Abelseth has been ordered to relinquish custody of the now 16-year-old girl and pay Barnes child support, telling local network WBRZ of her peril.
It was after he complained to a judge that she gave the teenage girl a cell phone. She is now campaigning to win back her rights, and to see him prosecuted.
Abelseth did not explain whether or not she physically consented to the sexual encounter in 2015 which occurred when she was 16 – a year under the legal age of consent in Louisiana.
In her 2015 police report, she described how she was ‘highly intoxicated’ when Barnes took her back to his home after meeting her in the bar where she’d been drinking with friends.
‘On December 13th, 2005, I was out at a bar with friends. We were drinking and highly intoxicated. The driver left [the other friend] and I at the bar.
‘John Barnes offered to take me home. Instead of bringing me to my house, John Barnes brought me to his home.
‘He proceeded to rape me,’ she told cops.
She claims that once she found out she was pregnant, she let relatives believe that the baby’s father was a boyfriend.
…Despite filing the report and it being within the state’s statute of limitations, Barnes was never charged.
In 2015, he was given 50/50 custody.
…The pair have shared custody for seven years but this year, Barnes obtained full custody.
He complained to Judge Jeffrey Cashe that the girl’s mother gave her a cell phone.
Now Abelseth is fighting to regain custody of her daughter.
She believes that a sexual assault report she filed against him with Tangipahoa Parish Sheriff’s Office has not been thoroughly investigated.
…Abelseth said she didn’t think she could file a criminal complaint against Barnes after the day of the assault, and only found out that the statute of limitations would allow her to do so through a trauma counselor.
‘I thought if I didn’t do it the next day, there was nothing I could do about it.
‘I went to a trauma counselor, and he said, “No, you have 30 years after you turn 18.”
Although Barnes has admitted he is the biological father of his child with Abelseth, he has not been charged in connection with her allegations of rape or statutory rape.
Louisiana Foundation Against Sexual Assault attorney Sean Cassidy told WBRZ he had never come across a case like this.
‘It seems pretty straight-forward that not only did a crime take place, but as a result of the crime, this person should not have custody of the child,’ he told the outlet.

The Louisiana man accused of raping a 16-year-old in 2005 when he was 30 has spoken out to deny the woman’s claims as he fights to maintain custody of their now teenage daughter.

Louisiana has statutory rape laws which apply if the victim is under 17, regardless of whether or not they physically consented.
Barnes has never been charged with rape or statutory rape, and he was recently awarded full custody of the couple’s daughter.
In an interview this week, he said he thought Abelseth was an adult when they met because she was in a bar using a fake ID.
‘It’s a lie. She was in a bar with a fake ID, telling everyone she was a college student.
‘I had no idea she was 16, and I didn’t rape her. That is absolutely, unequivocally false,’ he told FOX.
…He also denied ever laying a hand on his daughter or drugging her – as the girl’s mother recently alleged – and claimed he was granted custody of her after her mother gave her a second, unrestricted cell phone which she used to post ‘sexually explicit videos on TikTok’.
Abelseth alleged that he drugged and raped their daughter, claiming that is what he did to her when she was 16, and claiming that he was not charged because he was well-connected.
‘All I have been trying to do is protect my daughter. There is no way in hell I have influenced seven very high-level organizations that are geared toward protecting children’s rights and safety into sweeping her claims of rape and child abuse under the rug,’ he said.
…He says Abelseth created an unstable home for their daughter and allowed a ‘revolving door of men’ to sleepover in their house.
He also said he only discovered he was the child’s father in 2011 when she was five, and that a different man’s name was on her birth certificate.
That man was an ex-con who Abelseth visited in prison with her daughter, according to Barnes.
